Mediator Focus Workshops
Getting Parties to the Mediation Table
Mediators can face challenging logistical obstacles and resistance to mediation from disputing parties during the time leading up to mediation. Parties adopting positional hard-bargaining stances on every locistical issue can potentially derail the mediation process if matters are not managed effectively by the mediator. This 3-hour workshop is designed to raise and address some of the difficulties a mediator might face during the preparatory stages. By use of case studies and the exchange of successful approaches, the aim is to create a forum in which mediators can acquire new skills and methods to add to their tool-kits to keep mediation preparations on track.
Representing Clients in Mediation
With approximately 96% of cases settleing prior to court appearance, lawyers play an increasingly important role in the mediation process. This 3-hour module focuses on the mediation process and the role of the lawyer in assisting their client through mediation. A strong emphasis is place on the preparatory stage where invaluable work can be done by lawyers in preparing clients for a needs-based approach to dispute resolution.
Negotiating Contracts
The importance of negotiating effective contracts should not be underestimated as contracts define the framework for workable, successful relationships. This is a practical 3-hour workshop which introduces participants to key considerations and methods for approaching contractual negotiations in a prepared and focused manner. This module has been conducted for the Law Institute of Victoria, Clayton Utz Lawyers and the Hong Kong University Law School.
